J&J pay $9.9 million to settle surgical mesh implant case

Healthcare conglomerate Johnson & Johnson has agreed to pay $9.9 million to settle a Washington state lawsuit over the firm’s alleged misrepresentation of the risks of pelvic mesh implants.

Attorney General Bob Ferguson sued the New Jersey-based firm in 2016 alleging its subsidiary Ethicon had violated the Consumer Protection Act by failing to tell patients of the risks of pelvic mesh implants.

These risks included the potential for dire and sometimes irreversible complications such as urinary dysfunction, loss of sexual function, constipation and severe pain. The surgical mesh was intended to provide support when repairing damaged tissue.

As of yet, tens of thousands of patients have sued J&J and other companies over the surgical mesh. J&J however, did not admit wrongdoing.

The case comes after it was revealed litigation had cost J&J $423 million in the first quarter of 2019. The cost of litigation had in part led to a 14% loss in earnings in the first three months of the year.
