New EU Cosmetics Regulation

The European Cosmetics Directive has been recast and the new legislation takes the form of Regulation 1223/2009. As a Regulation, the new legislative framework is binding in its entirety on member states. Substantive improvements have been introduced in the recast which are intended to reinforce the safety of cosmetics products taking into consideration the latest technological developments, including nanomaterials.
The final provisions of the Regulation will apply from 11 July 2013 which means that there is only about a year and a half for companies to ensure that they are fully prepared to meet their obligations under the Regulation, e.g. the reporting of serious undesirable effects by distributors and the responsible person to the competent authority in the country concerned.
